On 1st April 2006 (no, this wasn’t an April Fool), the Regulatory Reform (Fire Safety) Order came into force. In one sweep, it scrapped a whole pile of existing fire legislation, including the Fire Precautions Act 1971, the Fire Precautions (Workplace) Regulations 1997/99, and the Management of Health & Safety in the Workplace Regulations 1999. In short, the rules changed, and they stayed changed.

One thing that still confuses is the idea of a ‘fire certificate’. There isn’t one. Fire risk assessment is not the same thing, and if someone tells you otherwise, back away slowly.

Essential Fire Safety Requirements for Businesses

What is required is that every business owner and employer can demonstrate the following, and yes, someone may actually ask:

  • All fire risks have been assessed and recorded in a written Fire and Risk Assessment, not a mental note.
  • Fire-fighting equipment has been provided, adequately maintained and regularly inspected, not just admired.
  • An Emergency Action Plan has been written, agreed and published somewhere people might actually read it.
  • Staff have received fire training in the use of equipment and procedures; waving vaguely at the fire extinguisher doesn’t count.
  • There are adequate fire detection systems, warning alarms and escape routes in place to allow everyone to leave the building safely and without drama.
  • Action plans have been created and signed off, outlining what will be done and, more importantly, when it will be done.
